1 General
1.1 This Privacy Statement describes how the Data Controller processes the personal data of the Users within the scope of the Website.
2 Personal Data
2.1 A piece of personal data refers to information about an identified or identifiable natural person. Depending on the use of the Website by users, the Data Controller can process the following data of its users:
i Name, company, VAT, KvK (Netherlands Chamber of Commerce), billing details, nationality, ID, bank and payment details;
ii (Email) address;
iii Phone number;
iv Data relating to the device of a user, such as an IP address;
v Communication preferences;
vi Information obtained through the use of cookies, regarding the User's browsing behaviour.
2.2 The Data Controller collects personal data from a User in the following way(s):
i when the User concerned has provided this personal data to the Data Controller through the Website;
ii when the User concerned contacts us with a request for information regarding the services or products of the Data Controller;
iii when the User concerned requests information about services, places an order, or a bid with the Data Controller; or
iv because they are generated from the use of the Data Controller's services or Website by the User, including through cookies; or
v from third parties, for example: business partners of the Data Controller, affiliated entities.
2.3 If the User is required to provide certain data, the User will be informed of the potential consequences if these are not provided.
3 Purposes and grounds for personal data processing
3.1 The Data Controller processes the personal data of a user in accordance with legal grounds stemming from the General Data Protection Regulation: performance of an agreement, fulfilment of a legal obligation, or a legitimate interest.

3.2 The Data Controller processes certain personal data to pursue our legitimate interests. The legitimate interests of the Data Controller include marketing, advertising, in-house study of own products or services, IT management and security, sharing with parties affiliated with the Data Controller and trading partners, etc.
3.3 The Data Controller processes personal data for the following purposes, on the basis of the corresponding grounds:

4 Provision of personal data to third parties
4.1 The Data Controller will not share the personal data of their Users with third parties unless:
4.1.1 the personal data are provided to a processor engaged by the Data Controller for the purposes listed in this Privacy Statement, with which processor the Data Controller has entered into an agreement ensuring, inter alia, that the processor provides sufficient guarantees in respect of technical and organisational security measures with regard to the processing operations to be performed; or
4.1.2 the Data Controller is required by law to transfer personal data to competent authorities; or
4.1.3 the Data Controller uses third-party service providers to perform certain services on behalf of the Data Controller, such as IT services or payment services.
4.2 In order to provide the services, the Data Controller may need to transfer personal data to other countries, within or outside the European Union. When this is the case, the Data Controller will take all reasonable steps to lawfully transfer the personal data to such countries.
5. Cookies
5.1 The Data Controller makes use of so-called 'cookies'. With these cookies, in accordance with the preferences specified by the User, the Data Controller automatically collects certain data about the history of the activities of the User on the Website and third-party apps. For example, personal data of the User may be collected while the User is using the Website or apps or if these are running in the background on device of the User. This data may be combined by the Data Controller with other data concerning the device of the User, such as an IP address. If the consent of the User is required for this, the Data Controller will ask for this in advance.
5.2 The Cookie Policy of the Data Controller, which can be found on the website, contains further information on the use of cookies, including the purposes for which the Data Controller uses cookies (see also section 3.3).
6 User rights
6.1 The User has the right to access, rectify and delete their personal data in accordance with the provisions of the General Data Protection Regulation. The User also has the right to object to the processing of their personal data.
6.2 The User can ask the Data Controller to limit the processing and data portability. The latter implies that the User has the right to receive the personal data that the Data Controller holds about them − in a structured, commonly used and machine-readable form − and, if necessary, to have these passed on by the Data Controller to another Data Controller.
6.3 If the User has consented to the processing of their personal data, the User has the right to withdraw this consent at any time.
6.4 If the User wishes to exercise any of these rights, or if the User has any questions about this Privacy Statement, the User can reach the Data Controller at info@industrial-auctions.nl.
6.5 Users can unsubscribe from the newsletter by sending an email to info@industrial-auctions.com.
6.6 Users have the right to lodge a complaint with the Personal Data Authority (Autoriteit Persoonsgegevens), this can be done via: https://www.autoriteitpersoonsgegevens.nl/en.
7 Retention period
7.1 The Data Controller stores personal data for a period of 60 months after the last visit to the Website, unless the Data Controller is obliged to retain this personal data for a longer period under a legal provision.
8 Amendments to this Privacy Statement
8.1 The Data Controller reserves the right to amend this Privacy Statement. Any adjustments will be announced on this page. The Data Controller advises the User to check this page regularly to see if any changes have been made. The current Privacy Statement was updated in January 2023.
